These Terms of Service (the “Terms”) govern your access to and use of PlotLeads (the “Service”). PlotLeads is a tool that provides lists of publicly available business listings sourced from Google Maps for business-to-business outreach. By creating an account, purchasing credits, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
This document is a plain-English statement of the terms on which we operate. It is not legal advice.
1. Acceptance
By accessing or using the Service you confirm that you are at least 18 years old, that you are using the Service for business purposes, and that you have the authority to enter into these Terms on behalf of yourself or the organisation you represent. If you are using the Service on behalf of an organisation, “you” refers to that organisation.
2. Description of the Service
PlotLeads compiles and delivers lists of publicly available business information — such as company name, phone number, website, rating, and address — gathered from Google Maps. The data concerns businesses, not consumers, and is provided for legitimate business-to-business purposes.
The data is sourced from third parties and public listings and may be incomplete, outdated, or inaccurate. We do not guarantee the accuracy, completeness, currency, or fitness for any particular purpose of any data delivered through the Service. You are responsible for verifying data before you rely on it.
3. Acceptable use
You are solely responsible for how you use the data and for ensuring that your outreach complies with all applicable laws and regulations. Depending on where you and your recipients are located, these may include the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), do-not-call rules, and the GDPR and ePrivacy rules where they apply. You must honour opt-out and do-not-contact requests.
You agree that you will not:
- use the data to contact, profile, or market to individual consumers, or for any business-to-consumer (B2C) purpose;
- resell, redistribute, sublicense, or republish the data as a standalone list or database;
- use the data for any unlawful, deceptive, harassing, defamatory, or abusive purpose;
- send unsolicited communications in violation of anti-spam, telemarketing, or privacy laws;
- attempt to disrupt, reverse engineer, or gain unauthorised access to the Service or its underlying systems; or
- use automated means to access the Service beyond the functionality we provide.
4. Credits and payment
Access to data is purchased using credits. Credits are sold in one-time packs (starting at $35 for the starter pack) and do not expire. Payments are processed by Stripe; we do not store your full card details. All prices are in US dollars.
Where a meaningful share of a delivered list is inaccurate, we will refund the corresponding credits to your account balance. Refunds are made in credits rather than to your original payment method unless we determine otherwise at our discretion. Because credits never expire, refunded credits remain available for future use.
5. Intellectual property and license
The Service, including its software, design, and branding, is owned by PlotLeads and its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the data you purchase for your own internal business-to-business outreach. This license does not permit resale or redistribution of the data as described in the acceptable use section.
6. Disclaimer of warranties
The Service and all data are provided “as is” and “as available” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
7. Limitation of liability
To the maximum extent permitted by law, PlotLeads and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. To the extent we are found liable, our total liability for any claim will not exceed the amount you paid us in the twelve months preceding the event giving rise to the claim.
8. Suspension and termination
We may suspend or terminate your account at any time if you breach these Terms, misuse the Service, or use it in a way that creates legal risk for us or others. You may stop using the Service at any time. On termination, the provisions of these Terms that by their nature should survive will continue to apply.
9. Changes to these Terms
We may update these Terms from time to time. When we make material changes we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
10. Governing law
[Governing law and jurisdiction: TODO — owner to confirm. The operator is based outside the United States while serving US customers, so the applicable governing law and venue must be set by the owner before these Terms are formalised.]
